Terms of Service & Privacy Policy (Combined)

Effective date: August 13, 2025

This document applies primarily to users in the United States and Canada. If you access the Service from other locations, you are responsible for complying with local laws.

Acceptance of Terms

By accessing or using EasyPic, you agree to these Terms of Service and our Privacy Policy (together, the "Terms"). If you do not agree, do not use the Service.

What EasyPic Does

EasyPic provides image/video/audio utilities (e.g., resize, compress, watermark, convert, title/keyword generation, transcript extraction) and may use third-party processors to run AI models and infrastructure. Processing times and output quality may vary by file size/type, network conditions, and third-party queues.

Accounts & Eligibility

You must be 13+ (US) to use the Service. If you are under 18, you represent you have parental consent to use the Service and make purchases.

You must provide accurate information and keep credentials confidential. You're responsible for all activity under your account.

We may suspend or terminate accounts for misuse, risk, or violations of these Terms.

Acceptable Use

You agree not to:

  • Upload or generate illegal content; infringe IP or privacy rights; share malware; or violate others' rights.
  • Use outputs to deceive, impersonate, or mislead (e.g., unlawful deepfakes).
  • Attempt to reverse engineer, scrape, overload, or disrupt the Service or our providers.

We may rate-limit or block traffic to protect the Service.

Your Content & Generated Output

You own your uploads. We do not claim ownership in your media.

License to operate the Service: You grant us a non-exclusive, worldwide, royalty-free license to host, process, transmit, and display your uploads and to generate outputs solely to provide the Service to you.

Outputs: Unless a third-party model's terms or law say otherwise, you own outputs we generate for you (e.g., titles, keywords, transcripts, resized assets). You are responsible for reviewing outputs and complying with marketplace rules (e.g., stock agencies, app stores).

AI & Accuracy Disclaimer

AI features can be inaccurate, incomplete, biased, or out-of-date. Do not rely on outputs for decisions in medical, legal, or financial contexts. Always review before publishing or commercial use. We provide no warranty that outputs meet any platform rules.

Availability & Changes

We may update, discontinue, or pause features without notice. We strive for reliability but do not guarantee uninterrupted Service. Third-party outages (e.g., model hosts, clouds, payment processors) can affect availability.

Plans, Credits, Billing & Refunds

We may offer free limits and paid plans/credits, shown in-app or on our pricing page.

Subscriptions renew automatically unless canceled before renewal.

Credits (if any) are non-transferable and expire as described in-app.

Fees exclude taxes unless stated.

Refunds: Digital services begin immediately; where permitted by law, fees are non-refundable. If local consumer laws grant you rights, we honor them.

Chargebacks & fraud: We may suspend accounts for suspected fraud or abuse.

Intellectual Property (Service)

The Service (software, UI, content, brand) is owned by us and our licensors. You may not copy, modify, or create derivatives except as permitted by these Terms.

Third-Party Links & Marketplaces

We're not responsible for third-party sites or marketplaces. If you export there, you must comply with their terms and policies.

Termination

You may stop using the Service anytime. We may suspend/terminate for violations, non-payment, or risk. Sections that should survive termination will continue (e.g., IP, disclaimers, limitation of liability).

Dispute Resolution (US) — Arbitration & Class-Action Waiver

PLEASE READ: For US users, any dispute arising out of or relating to the Service or these Terms will be resolved by binding arbitration before a single arbitrator under the AAA Consumer Arbitration Rules (or comparable forum).

Governing law: Laws of the State of Delaware, USA, excluding conflict-of-laws rules.

Venue for non-arbitrable claims: State or federal courts in New Castle County, Delaware; each party submits to jurisdiction there.

Class-action waiver: You agree to bring claims only in your individual capacity, not as a class member or representative.

Exceptions: Either party may bring an individual claim in small-claims court or seek injunction for IP/security misuse.

Opt-out: You may opt out of arbitration within 30 days of first acceptance by emailing easypic247@163.com with subject "Arbitration Opt-Out,\" including your account email and a clear statement opting out.

Canadian users: You may have rights under provincial consumer laws that cannot be waived. To the extent arbitration/class-action waivers aren't enforceable, local law controls.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill; or service interruptions. Our aggregate liability for any claim is limited to amounts you paid us in the 3 months before the claim (or $0 for free users).

Warranties Disclaimer

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Privacy Policy (US & Canada)

"Notice at Collection" (California)

We collect: account data (email, password hash), usage/diagnostics (feature events, device/browser, coarse IP-based location for security), uploads and generated outputs (only as needed to operate features), and limited payment info via our provider. We use this data to provide the Service, secure it, prevent abuse/fraud, bill for paid plans, and improve features. See details below and §21–§24 for your rights.

What We Collect

  • Account & Contact: email, password hash, profile preferences, subscription status.
  • Usage & Device: pages/features used, timestamps, device/browser type, coarse location (IP-based), crash/error logs.
  • Media & Outputs: files you upload and outputs generated—stored only as needed to process/deliver results or if you choose to save history.
  • Payments: processed by Stripe; we receive limited billing metadata (e.g., last 4 digits, status).
  • Cookies/Local Storage: essential auth/session and preference data; we avoid non-essential tracking unless you consent.

Why We Use Data (US lawful bases)

  • Contract: provide Service features you request.
  • Legitimate Interests: secure the Service, prevent abuse, measure essential usage, improve features.
  • Consent: for optional emails/marketing or non-essential cookies/analytics.
  • Legal Obligation: comply with applicable law (e.g., tax, fraud prevention).

Subprocessors & Hosting

To deliver the Service, we use vendors acting on our behalf, including (examples):

  • Hosting/CDN/Build: Netlify
  • Auth/DB/Storage: Supabase
  • Payments: Stripe
  • AI/Inference: Replicate (and similar providers as we add)
  • Email/Support/Analytics: Google Analytics, Zendesk

We bind them to appropriate confidentiality and data-processing terms. We'll keep an up-to-date list on this page or by link in the footer.

Data Retention & Deletion

  • Uploads & outputs: kept only as long as needed to process/deliver results, then auto-deleted, unless you enable history/archives or save files.
  • Account data: retained while your account is active; upon deletion, we remove or irreversibly de-identify data unless retention is legally required (e.g., billing records).
  • Logs: security and error logs retained for a reasonable period to protect the Service.

Security

We use reasonable technical/organizational safeguards (encrypted transport, access controls). No system is 100% secure. Report suspected incidents to easypic247@163.com.

US State Privacy Rights (CPRA/CCPA, etc.)

California residents: You have the right to know/access, delete, correct, opt out of "sale\" or \"sharing\" of personal information, limit use of sensitive personal information (SPI), and non-discrimination for exercising rights.

Categories collected: identifiers (email, IP), internet activity (usage logs), geolocation (coarse, IP-based), commercial info (subscription/transactions), and in limited cases inferences (feature preferences). We do not intentionally collect SPI.

Sale/Share: We do not sell personal information for money. If we use analytics/ads that might be deemed "sharing,\" you can opt out via \"Do Not Sell or Share My Personal Information\" link or in-app toggle or by emailing easypic247@163.com.

Requests: Submit access/delete/correct/opt-out requests at https://easypic.app/privacy-request or email. We will verify reasonable proof of identity and respond within statutory timelines.

Nevada: You may opt out of "sale" under Nevada law by emailing easypic247@163.com.

Virginia/Colorado/Connecticut/Utah (and similar laws): You may have rights to access, delete, correct, and opt out of targeted advertising or profiling. Use the same contact or in-app settings. If we deny a request, you can appeal by replying "Appeal" to our response.

Do Not Track: We do not respond to "Do Not Track" signals; use our in-app privacy controls and opt-outs above.

Canada (PIPEDA & Provincial Laws, including Québec Law 25)

If you are in Canada, you have rights to access and correct your personal information. You may also withdraw consent for optional processing and unsubscribe from marketing.

Purposes: operate and improve the Service; billing; security/fraud prevention; support communications.

International Transfers: we may process/store data in the United States and other countries. We use contractual and technical safeguards appropriate to the sensitivity of data.

CASL (anti-spam): We send marketing emails only with express or implied consent; you can unsubscribe anytime via the link in emails or by contacting us.

Québec Law 25: We designate a Privacy Officer (see §27 Contact) responsible for personal information governance and incident response.

Children's Privacy (COPPA)

The Service is not directed to children under 13. We do not knowingly collect personal data from children under 13. If you believe a child has provided personal data, contact us and we will delete it.

Marketing Communications

US (CAN-SPAM): We include sender information and an unsubscribe mechanism in marketing emails; you may opt out at any time.

Canada (CASL): We obtain your consent (express or implied) before sending commercial electronic messages; unsubscribe is honored promptly.

Cookies & Tracking

We use necessary cookies for login/session and preferences. If we add analytics/ads requiring consent, we'll present control options (e.g., an in-app toggle or banner) and respect your choices.

International Transfers (US/Canada → elsewhere)

We may transfer personal information to the US or other countries where we or our subprocessors operate. We implement reasonable contractual, technical, and organizational safeguards appropriate to the sensitivity of the data.

Changes to These Terms

We may update these Terms and will revise the Effective date above. Material changes will be announced in-app or via email when feasible. Continued use after changes means you accept the updated Terms.

Governing Law

US users: These Terms are governed by the laws of the State of Delaware, USA, except where federal law applies (e.g., arbitration under the FAA).

Canadian users: Local consumer protection laws may apply in addition to these Terms. Where a conflict exists, non-waivable rights under your provincial/federal law prevail.

Summary (non-binding)

  • You own your uploads; we only process them to deliver results you requested.
  • Review AI outputs; they can be wrong.
  • We use providers like Stripe, Supabase, Netlify, Replicate.
  • We try to auto-delete transient processing files shortly after completion.
  • You can request access/delete/correction (US state rights, PIPEDA).
  • You can opt out of "sale/sharing\" where applicable and unsubscribe from marketing.
  • Disputes (US) go to arbitration unless you opt out within 30 days.
  • Keep your account secure; don't misuse the Service.
